Terms of Service

1. Acceptance of the Terms
These Terms of Service (“Terms”) govern access to and use of the Atlete Elite platform, including the website and mobile applications (collectively, the “Platform”), operated by Atlete Elite SL, a company incorporated in Spain (“Atlete Elite SL”, “we”, “us”, or “our”).
By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Eligibility and Age Requirements
The Platform is available to users aged 13 years or older. Use of the Platform is subject to applicable laws and regulations.
Users aged 13–15 confirm that they have obtained consent from a parent or legal guardian to use the Platform. Parents or legal guardians are responsible for supervising the minor’s use of the Platform.
Users under the age of 16 are not eligible for paid, targeted, behavioural, or programmatic advertising, and their personal data is not used for advertising or marketing purposes.
3. Description of the Platform
Atlete Elite is a sports-focused digital platform designed to host and showcase content from verified professional athletes and, in the future, selected sports-related brands.
The Platform enables fans to access sports-related content and enables athletes to manage their own profiles and content.
For athletes and other content creators, Atlete Elite does not guarantee visibility, engagement, monetisation, or commercial outcomes.
Any advertising or commercial arrangements with brands are governed solely by separate written agreements.
4. User Accounts
The Platform currently supports fan accounts and verified athlete accounts. Brand accounts may be introduced at a later stage.
Users must provide accurate and up-to-date information and are responsible for all activity conducted through their accounts.
Athlete accounts are subject to manual review and verification. Atlete Elite SL reserves the right to approve, reject, revoke verification, reclassify, suspend, or remove accounts at its discretion, including where eligibility, relevance, compliance, or platform focus changes.
5. Content Submission and User Representations
Users who upload content represent and warrant that:
a) They are the individual they claim to be
b) They have the legal right to upload the content
c) The content does not infringe third-party rights
d) The content complies with these Terms and applicable law
Automated, deceptive, or impersonating activity is prohibited.
6. Content Ownership and Licensing
Users retain ownership of their content.
By uploading content, users grant Atlete Elite SL a non-exclusive, worldwide, royalty-free licence to host, store, display, distribute, and make the content available within the Platform for operational and platform-related promotional purposes.
Any use of athlete content outside the athlete’s own profile, including platform marketing or Atlete Elite SL–controlled social media, will occur only with the athlete’s explicit permission.
Licences granted to Atlete Elite SL survive account termination or deactivation to the extent necessary to preserve platform integrity, historical or mixed content, and prior authorised use.
7. Content Moderation and Editorial Discretion
Atlete Elite SL reserves the right, but has no obligation, to review, moderate, restrict, or remove content or accounts at its discretion.
This includes content that is inappropriate for younger audiences, misaligned with platform standards or values, presents reputational, legal, or business risk, or is otherwise unsuitable, even if lawful.
Atlete Elite SL is not obligated to host or continue hosting any content.
8. Advertising and Commercial Content
Atlete Elite may display advertising or sponsored content on the Platform, including alongside athlete content.
Advertising refers to paid or platform-delivered advertising placements.
Content uploaded natively by athletes or brands, including content that may feature or reference commercial products or services, is treated as user-generated content and not advertising delivery by Atlete Elite.
Use of the Platform does not entitle athletes or users to compensation, revenue sharing, or participation in advertising revenue.
9. Payments and Financial Transactions
Except where expressly agreed in a separate written agreement with a brand or commercial partner, Atlete Elite SL does not currently:
a) Process payments
b) Offer subscriptions to users or athletes
c) Facilitate payouts or revenue sharing
d) Act as an intermediary for financial transactions between users
10. Prohibited Conduct
Users must not:
a) Upload unlawful or infringing content
b) Harass, abuse, or impersonate others
c) Circumvent platform safeguards
d) Exploit the Platform for unauthorised commercial use
e) Attempt to reverse engineer, disrupt, or misuse the Platform
11. Intellectual Property
All Platform software, design, branding, and related intellectual property are owned by or licensed to Atlete Elite SL.
Users may not copy, reproduce, or exploit Platform elements without permission.
12. Account Suspension, Termination, and Data Requests
Users may stop using the Platform at any time.
Atlete Elite SL may suspend, restrict, or terminate accounts or remove content at any time, with or without notice, to enforce these Terms or protect the Platform, users, or Atlete Elite SL.
Requests relating to personal data are handled in accordance with the Privacy Policy.
13. No Agency, Employment, or Partnership
Use of the Platform does not create any agency, employment, partnership, fiduciary, or representative relationship.
Atlete Elite SL does not act as an agent, manager, or representative for athletes.
14. Platform Availability and Changes
The Platform is provided “as is” and may change, evolve, or be discontinued at any time.
Atlete Elite SL does not guarantee uninterrupted or error-free operation.
15. Limitation of Liability
To the maximum extent permitted by law, Atlete Elite SL shall not be liable for user-generated content, business or commercial outcomes, or losses arising from Platform use or unavailability.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain.
We encourage users to contact us first to resolve issues.
Any disputes shall be subject to the exclusive jurisdiction of Spanish courts.
17. Changes to the Terms
Atlete Elite SL may update these Terms from time to time.
These Terms are written in English. In the event of any inconsistency between translated versions, the English version shall prevail.
Continued use of the Platform constitutes acceptance of the updated Terms.
